Police have been barred from arresting 12 National Super Alliance officials over their role in the swearing-in of Raila Odinga last week. He was granted bail of 50,000 Kenyan shillings ($500) but has remained in police custody with his whereabouts unknown until he appeared in court in Kajiado County, neighbouring Nairobi, on Tuesday to hear the charges.

In the first charge Miguna is accused of being present and consenting to the administration of an oath to commit a capital offence namely treason contrary to section 59 (a) of the Penal Code.

Justice Kimaru had on Monday morning summoned the IG and DCI to appear in court at 2 pm to give an explanation as to why they should evade judges of contempt for failing to comply with orders issued on Friday for the release of Miguna.

Mr Miguna Tuesday narrated how he was held incommunicado for five days without access to his family or a lawyer following his arrest last Friday.

"As soon as we serve the order this morning I expect the stations to be back on", he said.

The government was not served with the court order on Thursday afternoon because of a delay at the court registrar's office, Okiya Omtatah, an activist who filed the High Court case and won the lifting of the suspension, told Reuters.

Odinga supporters say they are angered by police impunity, persistent government corruption and the perceived neglect of large swathes of the country by the central government.

Also on Tuesday, the government suspended the passport of David Ndii, an opposition strategist, according to a letter he posted on Twitter.

Odinga ran against Kenyatta in an election last August which was nullified by the Supreme Court on procedural grounds.

The government took three private television channels off the air on Tuesday as they began to cover of the opposition ceremony. "What they are doing is reminiscent of the assassination of JM Kariuki and other political detainees who have died due to government illegal actions", said Havi.
