INX Media case: SC asks Karti Chidambaram to move Delhi HC for interim relief

The Delhi High Court on Friday granted interim relief to Karti Chidambaram from Enforcement Directorate arrest in connection with INX Media Case.

Karti Chidambaram, on Friday, was again sent to three-day CBI custody by a Delhi court.

The Bench said if the trial court decides to grant bail to Karti in the CBI case, it shall impose conditions such as the accused shall appear before the ED as and when called by the investigating officer and cooperate in the probe.

The bench, also comprising Justices A M Khanwilkar and D Y Chandrachud, also allowed Karti to withdraw his plea pending with the apex court related to the money laundering case.

Karti Chidambaram was arrested on February 28 from Chennai Airport and has been since in CBI custody. You (the court) will have to deal with 50 such petitions everyday. "What message we will be sending to others", Mehta said.

Karti is under the custody of the CBI which produced him today before a special court here and has sought his further custodial interrogation for six more days.

Karti will now be in CBI custody till March 12.

The ASG termed it a typo (error) in the CBI's remand application with regard the company's address issue and said what the agency meant was the "incriminating material" recovered from the ASPL office. But passing any interim order would have serious repercussions. It's like the high court does not know what to do.

Mehta retorted, "this statement of my learned friend (Sibal) was bad in taste and should not be made. We wanted that to be clear... because the law doesn't allow that to be done", he had explained.

They further added that Karti would be confronted with CA Bhaskaraman and Indrani Mukherjee as well. The lawyers of Karti has argued that the Enforcement Directorate has no jurisdiction can not have any sort of investigation not related to the allegations in the FIR lodged by the Central Bureau of Investigation or CBI.

"The CBI has been able to give sufficient ground and justified reasons to show that it is possible to uphold the contention of the CBI that for the goal of further and complete investigation, further custody of the accused is necessary to ensure continuity and to speed up investigation to secure the evidence, which may be useful at the trial or to arrive at the truth", the judge said in his order. It had also resisted any interim protection to him from the Supreme Court.

The Central Bureau of Investigation (CBI) requested Special Judge Sunil Rana for the narco test, saying it would help unearth the conspiracy in the case.

Karti is now in the custody of the CBI which arrested him at Chennai Airport on February 28.
