Political slugfest erupts over SC's Loya verdict

A three-judge bench, headed by Chief Justice of India Dipak Misra and comprising Justices A M Khanwilkar and D Y Chandrachud, pronounced its verdict after hearing a clutch of petitions. "There is no ground for the court to hold that there was a reasonable suspicion about the cause or circumstances of death which would merit a further inquiry". The same day senior advocates for petitioners say pressure being exerted on them to leave the case.

Congress party was not a petitioner before the Supreme Court. The court wondered how the senior lawyers made such callous and unverified allegations and felt it necessary to protect judges of the district judiciary and stood by their statements realising how vulnerable they are to "wanton attacks" on their independence.

Reacting to Thursday's judgment, one of the petitioner's lawyer Prashant Bhushan said, "It is unfortunate that the demand for an independent probe shot down by the court".

"The circumstances of Judge Loya's death raised several questions". He also said that petition had personal interest, not public interest.

In the Sohrabuddin Sheikh fake encounter case, BJP President Amit Shah along with Rajasthan Home Minister Gulabchand Kataria, Rajasthan-based businessman Vimal Patni, former Gujarat police chief P C Pande, Additional Director General of Police Geeta Johri and Gujarat police officers Abhay Chudasama and N K Amin have already been discharged.

"There is a grave danger that if this state of affairs is allowed to continue, it would seriously denude the efficacy of the judicial system by detracting from the ability of the court to devote its time and resources to cases which legitimately require attention".

The apex court's decision labelled these petitions as "scandalous" and "an attack on the image of the Judiciary".

In the context of the case, as per the official records, Justice Loya died of cardiac arrest in Nagpur in 2014, a day after he attended the wedding and reception of his colleague's daughter. The National Informatics Centre (NIC) does not maintain the Supreme Court's system, said the report, adding that Cert-IN, the Ministry's emergency response team, had advised the Supreme Court on the steps to be taken to restore the website and would analyse the details of the incident, quoting a Ministry spokesperson.

"Rahul Gandhi should apologise. Had there been any doubt, the Supreme Court would have directed some enquiry". "There are a number of unanswered questions", said Srinivas Loya, the uncle of the judge. "I urge Rahul Gandhi (Congress president) not to fight political battles through corridors of court", as per ANI.

However, Loyas son had on January 14 said in Mumbai that his father had died of natural causes. Most Indians, including those in the BJP, instinctively understand the truth about Mr Amit Shah.
