A decision to reconsider the recommendation was deferred after the collegium comprising Chief Justice Dipak Misra and four other senior most judges - Justices Jasti Chelameshwar, Ranjan Gogoi, Madan B. Lokur and Kurian Joseph - met for about 45 minutes.

The Supreme Court's five-member collegium on Wednesday met briefly but adjourned for next week its discussion on the Centre's rejection of the candidature of Chief Justice of Uttarakhand High Court K M Joseph for elevation to the highest court.

Justice Joseph's name was recommended along with the senior advocate Indu Malhotra on 10 January for their elevation as apex court judges.

The short resolution published on the Supreme Court website did not assign any reason for why the decision was deferred.

A number of Supreme Court lawyers urged the top court to put on hold Malhotra's appointment and direct the government to clear Joseph's name - a request that was rejected by a bench led by the chief justice Misra.

"The proposal for reconsideration of the case of K.M. Joseph has the approval of President and Prime Minister", said the letter that was sent to the Chief Justice by Union Law Minister Ravi Shankar Prasad.

The present government had, at that time, hived-off Senior Counsel Gopal Subramanium's name, though his name had been recommended by the collegium as well.

It was also learnt that the collegium did not discuss any specific names of other high court chief justices for elevation to the Supreme Court.

Indu was sworn in as the judge of the Supreme Court on April 27. And justice Joseph's order was confirmed by justice J S Khehar of the Supreme Court, who had also set aside the National Judicial Appointments Commission Act; yet Khehar became CJI under the NDA government, Prasad said.

Many backers of the Uttarakhand Chief Justice have alleged that he is being penalised for his verdict striking down the dismissal of the Congress government in the state previous year and are keen on his early elevation since the Centre will have no choice but to acquiesce to any reiteration by the collegium. He was appointed a permanent judge of the Kerala High Court on October 14, 2004 and assumed charge of the Uttarakhand High Court on July 31, 2014.

The run-up to the meeting of the collegium saw a group of senior advocates, activist lawyers, and retired judges, including a former CJI, building up pressure for immediate reiteration of the recommendation for Justice K M Joseph.

The members of the collegium including Justices Chelameswar, Gogoi, Lokur and Kurian Joseph had expressed concern over the delay in clearing the name of the Uttarakhand chief justice as the apex court judge.
